1. General notes

When you use this website, various kinds of personal data are collected and processed. Personal data is data by which you can be personally identified.

The owners of this website take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this data protection declaration.

By using this website, you consent to the collection and processing of your personal data at home and abroad as described in this declaration.

The data protection declaration published on this website at the time of use applies to the use of the website.
If you wish to make special contractual arrangements with us concerning the protection of your privacy with regard to the services we offer, please contact us separately at the address given in point 2 below.

2. Who is responsible for data collection on this website?

Data processing on this website is carried out by the website owner:

Forward Benchmark AG

8004 Zürich

Service Excellence Cockpit
Telephone: +41 44 350 13 22
E-mail: info@service-excellence-cockpit.ch

If you have any questions or concerns about your privacy, you can contact us at any time at this address.

3. How do we collect your data?

The first type of data we collect is that with which you provide us. This may be the data you enter in a contact form, for example.
The second type is the data automatically collected by our IT systems when you visit the website. This data is primarily technical (e.g. your internet browser, operating system or time when you accessed the page). Please refer to the description under point 7 below for details on the technical collection and use of the data by cookies, analysis tools and plug-ins from third parties.

If you send us enquiries using the contact form, we store your details from the form, including your contact data, to process the enquiry and in the event of follow-up questions. If you provide us with the personal data of third parties, please ensure that the person concerned agrees.

We keep the data entered in the contact form until you ask us to delete it or revoke your consent to its storage. This also applies when the reason for storing it is no longer relevant (e.g. after processing your request).

Mandatory legal provisions – particularly storage periods – remain unaffected by this.

4. What do we use your data for?

We use your data exclusively for the purposes described in this data protection declaration: namely, to market and provide services, to send your enquiries via the contact form or to send you the newsletters you order from us. Some of the data is collected to ensure that the website is error-free. Data created during the use of the website can also be used to analyse your user behaviour. Please refer to the description under point 7 below for details of the technical collection and use of data by cookies, analysis tools and third-party plug-ins.

5. What rights do you have regarding your data?

5.1 Rights of individuals affected

Under applicable law, you have the right at any time to free information about your stored personal data, its origin and recipients. You also have the right to know the purpose of data processing and, if applicable, the right to correct, block or delete this data.

5.2 Right of appeal

Furthermore, in the event of a violation of data protection law, you have the right to take legal action and lodge a complaint with the relevant supervisory authority.
The supervisory authority responsible for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

5.3 Revocation of consent

Some data processing operations, such as the sending of the newsletter described in point 8 below, are possible only with your express consent. You can revoke your consent at any time. To do this, send us an e-mail (no form required). The legitimacy of any data processing carried out before your revocation remains unaffected by it.

5.4 GDPR

As a Swiss association, we are subject to the Swiss Data Protection Act. However, we also endeavour to comply with the standards of the EU General Data Protection Regulation (GDPR), which came into force on 25 May 2018, for users from the EU. If you wish to assert special rights under the GDPR or have any other concerns in this regard, please contact us at the address given in point 2 above.

6. Technical and organizational measures

This website uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send us as the website owner. You can recognize an encrypted connection from the fact that your browser’s address line changes from “http://” to “https://” and shows a lock symbol on the left in the address line.

If SSL or TLS encryption is activated, third parties cannot read any data you transmit to us.

However, you should be aware that data transmission via the internet (e-mails, for example) can be subject to security gaps. Protecting data completely from access by third parties is not possible.

7. Third-party cookies, analysis tools and plug-ins

When you visit our website, third parties abroad may statistically evaluate your personal data and surfing behaviour. They do so using cookies or analysis apps and plug-ins.

Sometimes, you can use technical settings to block such data collection and processing. Please note, however, that if you do this, some of the website’s functions may not be fully available.

7.1 Cookies

Some websites use cookies. Cookies do not damage your computer and do not contain viruses. They help to make our website safer, more effective and more user-friendly. Cookies are small text files that are stored on your computer by your browser.

Most of the cookies we use are known as “session cookies” and are automatically deleted at the end of your visit. Others remain stored on your device until you delete them. These cookies enable us to recognize your browser when you next visit our website.

You can set your browser to inform you when cookies are created, only allow cookies individually or accept cookies in certain cases. You can also generally exclude them and activate the automatic deletion of cookies when closing the browser. If you deactivate cookies, the website’s functionality may be restricted.

Cookies required to carry out the electronic communication process or provide functions you have requested (e.g. the shopping cart function) are stored. The website owner has a justified interest in storing cookies to ensure optimum, error-free services. When other cookies – those used to analyse your surfing behaviour, for instance – are stored, these are described separately in this data protection declaration.

7.2 Server log files

The website owner automatically collects and stores information in server log files, which your browser automatically transmits to us. These are:

  • your IP address
  • your browser type and version
  • the operating system used
  • the referrer URL
  • the hostname of the accessing computer
  • time of the server request

This data is not merged with other data sources. The website owner has a legitimate interest in ensuring optimum, technically error-free presentation of his website. To enable him to do, he needs to record the server log files.

7.3 Google Analytics

This website uses functions from the Google Analytics web analysis service. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses cookies. These are text files that are stored on your computer and enable analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to and stored by Google on servers in the USA.

The website owner has a legitimate interest in analysing user behaviour in order to optimize both his website and advertising.

7.3.1 IP anonymization

We have activated the IP anonymization feature on this website. As a result, Google truncates your IP address within member states of the European Union or other signatory states to the Agreement on the European Economic Area prior to transmission to the USA. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. Acting on behalf of the owner of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google.

7.3.2 Google Browser Plugin

You can prevent the storage of cookies by selecting the appropriate settings on your browser. However please note that if you do this, you may not be able to use the full functionality of this website. You can also prevent Google from collecting the data generated by the cookie and related to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

7.3.3 Objection to data collection

You can prevent Google Analytics from collecting your data by clicking on the following link. It creates an opt-out cookie that prevents the collection of your information on future visits to this website: deactivate Google Analytics.

For more information as to how Google Analytics handles user data, please see Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

7.3.4 Order processing

We have signed the standard contract with Google published on the company’s website for the processing of order data, in which Google guarantees compliance with European data protection regulations.

7.3.5 Demographic characteristics of Google Analytics

This website uses “Demographics and Interests” data in Google Analytics, which provides us with information about the age, gender and interest categories of site visitors. This data comes from Google’s own interest-related advertising and visitor data from third parties and cannot be linked with a specific individual. You can deactivate this function at any time using the ad settings in your Google Account or generally prohibit the collection of your data by Google Analytics as described under “Objection to data collection”.

7.4 Google Web Fonts

This website uses web fonts provided by Google to enable the uniform display of fonts. When you access a site, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.

To facilitate this, the browser you are using needs to connect to Google’s servers. This informs Google that our website has been accessed via your IP address. We use Google Web Fonts to make the presentation of our online offers as uniform and appealing as possible. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

If your browser does not support web fonts, your computer will use a standard font.

For more information about Google Web Fonts, see https://developers.google.com/fonts/faq and Google’s Privacy Policy: https://www.google.com/policies/privacy/.

7.5 Google Maps

This site uses Google Maps via an API. The owner is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To access Google Maps and its features, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The owner of this website has no influence on this data transfer.

We use Google Maps to ensure an appealing presentation of our online offers and to make it easier for visitors to locate the places we refer to on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

You can find more information about the handling of user data in Google’s privacy policy: https://www.google.de/intl/de/policies/privacy/.
